In Gender and Tradition in Marriage and Divorce: An Analysis of Personal Laws of Muslim and Hindu Women in Bangladesh, Rabia Bhuiyan has annalysed the critical issues which affect Muslim and Hindu women in Marriage and Divorce. Approaching her subject from varipus angles, she points out from her own experience that the Qur'anic provisions and in many ways fail to address the contemporary needs of Muslim Women. Women become victims of child marriage, polygamy, hilla, and unilateral divorce without any right to marital property or post-divorce maintenance. She also highlights that because of its diverse and misogynistic interpretations, illegal fatwas are given and as such women suffer from violence and injustice. In many respects, existing personal laws conflict with the Constitutional rights and statutory reforms and even the Courts reach contradictory decisions. Traditional personal laws are confusing which call for immediate reforms and codification. Many Muslim Countries have brought reforms either through ijtehad or resorting to civil law. Islam preaches human rights and ensured status of women. Hindu personal laws laso require reforms. In India, reforms were brought through legislation. Similar reforms can be made here. Rabia Bhuiyan also analyses various methodologies of reforms taken and proposed for the welfare of women and the society at large.
